l\u2019\u00e9tablissement a<strong> 8 jours ouvr\u00e9s pour r\u00e9pondre<\/strong> (apr\u00e8s un d\u00e9lai de r\u00e9flexion de 48 heures). <strong>Le d\u00e9lai est port\u00e9 \u00e0 2 mois<\/strong> lorsque les informations datent de <strong>plus de 5 ans.<\/strong><\/span><\/p><h2><span style=\"color: #00003f;\">La communication<\/span><\/h2><p><span style=\"color: #00003f;\">Elle se fait par <strong>l\u2019envoi en recommand\u00e9 avec accus\u00e9 de r\u00e9ception<\/strong> des copies du dossier m\u00e9dical ou <strong>par remise en mains propres<\/strong>.<\/span><\/p><p><span style=\"color: #00003f;\">L&rsquo;envoi par courriel n&rsquo;est pas autoris\u00e9 car ces documents\u00a0sont soumis au secret et\u00a0sont donc\u00a0non communicables de cette fa\u00e7on (en dehors d&rsquo;une messagerie crypt\u00e9e professionnelle).<\/span><\/p><p><span style=\"color: #00003f;\">Les premi\u00e8res copies sont gratuites seuls sont factur\u00e9s les frais d\u2019envoi (accus\u00e9 de r\u00e9ception)<\/span><\/p><h2><span style=\"color: #00003f;\">Que peut-on obtenir ?<\/span><\/h2><p><span style=\"color: #00003f;\">Toutes les informations du dossier m\u00e9dical qui ont contribu\u00e9 \u00e0 l\u2019\u00e9laboration et au suivi du diagnostic et du traitement, ou qui ont<\/span><br \/><span style=\"color: #00003f;\">fait l\u2019objet d\u2019\u00e9changes \u00e9crits entre professionnels de sant\u00e9. Ce sont :<\/span><\/p><ul><li><span style=\"color: #00003f;\">Les r\u00e9sultats d\u2019examens<\/span><\/li><li><span style=\"color: #00003f;\">Les comptes-rendus de consultation, d\u2019intervention, d\u2019exploration ou d\u2019hospitalisation<\/span><\/li><li><span style=\"color: #00003f;\">Les protocoles et prescriptions th\u00e9rapeutiques<\/span><\/li><li><span style=\"color: #00003f;\">Les feuilles de surveillance<\/span><\/li><li><span style=\"color: #00003f;\">La correspondance entre professionnels de sant\u00e9 (\u00e0 l\u2019exception d\u2019informations recueillies aupr\u00e8s de tiers n\u2019intervenant pas dans la prise en charge)<\/span><\/li><\/ul><h2><span style=\"color: #00003f;\">Cas particuliers<\/span><\/h2><p><span style=\"color: #00003f;\"><strong>Apr\u00e8s un d\u00e9c\u00e8s<\/strong> : le secret m\u00e9dical ne fait pas d\u2019obstacle \u00e0 ce que les informations concernant une personne d\u00e9c\u00e9d\u00e9e soient d\u00e9livr\u00e9es aux ayants droits (sauf volont\u00e9 contraire exprim\u00e9e par la personne avant son d\u00e9c\u00e8s). Ceux-ci doivent justifier de leur identit\u00e9, de leur statut d\u2019ayant-droit et pr\u00e9ciser la raison pour laquelle ils veulent acc\u00e9der au dossier m\u00e9dical : conna\u00eetre les causes de la mort, d\u00e9fendre la m\u00e9moire du d\u00e9funt ou faire valoir leurs droits.<\/span><\/p><p><span style=\"color: #00003f;\">Un mineur peut s\u2019opposer \u00e0 ce que des informations le concernant soient d\u00e9livr\u00e9es \u00e0 ses parents (ou au titulaire de l\u2019autorit\u00e9 parentale). Le m\u00e9decin doit s\u2019efforcer d\u2019obtenir son consentement mais si le mineur maintient son opposition, il n\u2019est pas possible de satisfaire la demande des parents (l\u2019\u00e9crire dans le dossier)<\/span><\/p><p><span style=\"color: #00003f;\">Si le praticien ayant adress\u00e9 le patient demande la communication du dossier, elle ne peut intervenir qu\u2019avec l\u2019accord du patient (ou du tuteur ou de l\u2019ayant droit).<\/span><\/p><\/div><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bcd8f04
