Les d\u00e9lais<\/span><\/h2>

A r\u00e9ception de la demande, l\u2019\u00e9tablissement a 8 jours pour r\u00e9pondre<\/strong> (apr\u00e8s un d\u00e9lai de r\u00e9flexion de 48 heures). Le d\u00e9lai est port\u00e9 \u00e0 2 mois<\/strong> lorsque les informations datent de plus de 5 ans.<\/strong><\/span><\/p>

La communication<\/span><\/h2>

Elle se fait par l\u2019envoi de copies du dossier m\u00e9dical par voie postale en lettre recommand\u00e9e avec avis de r\u00e9ception, par mail ou par remise en main propre directement aupr\u00e8s du secr\u00e9tariat m\u00e9dical concern\u00e9.<\/span><\/p>

Les premi\u00e8res copies sont gratuites seuls sont factur\u00e9s les frais d’envoi (accus\u00e9 de r\u00e9ception) <\/span><\/p>

Que peut-on obtenir ?<\/span><\/h2>

Toutes les informations du dossier m\u00e9dical qui ont contribu\u00e9 \u00e0 l\u2019\u00e9laboration et au suivi du diagnostic et du traitement, ou qui ont<\/span>
fait l\u2019objet d\u2019\u00e9changes \u00e9crits entre professionnels de sant\u00e9. Ce sont :<\/span><\/p>

  • Les r\u00e9sultats d\u2019examens<\/span><\/li>
  • Les comptes-rendus de consultation, d\u2019intervention, d\u2019exploration ou d\u2019hospitalisation<\/span><\/li>
  • Les protocoles et prescriptions th\u00e9rapeutiques<\/span><\/li>
  • Les feuilles de surveillance<\/span><\/li>
  • La correspondance entre professionnels de sant\u00e9 (\u00e0 l\u2019exception d\u2019informations recueillies aupr\u00e8s de tiers n\u2019intervenant pas dans la prise en charge)<\/span><\/li><\/ul>

    Cas particuliers<\/span><\/h2>

    Apr\u00e8s un d\u00e9c\u00e8s : le secret m\u00e9dical ne fait pas d\u2019obstacle \u00e0 ce que les informations concernant une personne d\u00e9c\u00e9d\u00e9e soient d\u00e9livr\u00e9es aux ayants droits (sauf volont\u00e9 contraire exprim\u00e9e par la personne avant son d\u00e9c\u00e8s). Ceux-ci doivent justifier de leur identit\u00e9, de leur statut d\u2019ayant-droit et pr\u00e9ciser la raison pour laquelle ils veulent acc\u00e9der au dossier m\u00e9dical : conna\u00eetre les causes de la mort, d\u00e9fendre la m\u00e9moire du d\u00e9funt ou faire valoir leurs droits.<\/span><\/p>

    Un mineur peut s\u2019opposer \u00e0 ce que des informations le concernant soient d\u00e9livr\u00e9es \u00e0 ses parents (ou au titulaire de l\u2019autorit\u00e9 parentale). Le m\u00e9decin doit s\u2019efforcer d\u2019obtenir son consentement mais si le mineur maintient son opposition, il n\u2019est pas possible de satisfaire la demande des parents (l\u2019\u00e9crire dans le dossier)<\/span><\/p>
